Terms of service

These terms cover the free tools on this site and, together with a quote you accept, the paid services. The provider is [to be completed] — see the legal notice.

1. Who the services are for

The services are offered to businesses and professionals. If you are a consumer, the rights consumer law gives you still apply, including those in section 11.

2. The free tools

The scanner, the account and the assessment are free and provided as they are. A scan's verdict is an automated reading of public pages: an indication, not a promise and not an offer. The scanner identifies itself, respects robots.txt, and is rate-limited; please use it for sites you have a reason to look at.

3. Quotes and contracts

The indicative range we give after the assessment is not an offer. A quote is: it states the scope, the price, the schedule, the payment terms and how long it stands. A contract is formed when you accept a quote, in your account or in writing. Work outside a quote's scope is quoted separately before it is done.

4. The migration audit

The audit is a fixed-price rehearsal of the migration on a copy of your site. It ends with a written report and a firm quote for the conversion. Its price is deducted from the conversion when you accept that quote while it stands.

5. What you provide

For the assessment, temporary access to your server — SSH or a hosting control panel — that you create and remove, and which we use only to read. For a conversion, a Cloudflare® account opened in your own name — the Free plan is enough, and we never open one on your behalf — and the access listed in the quote — WordPress administrator, hosting control panel or SSH, DNS — for the length of the project, and confirmation that you are entitled to give it. Before we change anything on your live WordPress, we confirm with you that a current backup exists.

6. How access ends, and your data

At the end of the project we list every account and key we used, and you remove them; we keep no credentials. Personal data we can see while we work is processed only on your instructions, under the data processing agreement (GDPR art. 28) that comes with every quote.

7. Payment

As set out in the quote. Invoices are in euros, VAT is added where the law requires it, and payment is due within the period stated on the invoice. For business customers, late payment carries interest under Spanish Law 3/2004.

8. Care plans

A care plan is monthly and starts on the date agreed. Either side can end it with one month's notice, taking effect at the end of a calendar month. Ending it never affects your site, which keeps running in your own Cloudflare account.

9. What is yours

Your content, your WordPress, your Cloudflare account, your domain and the repository your edge is deployed from are yours. Code written specifically for your site becomes yours once it is paid for. The shared components — the edge functions every site uses, and the plugin that keeps WordPress and the edge in step — remain ours or their licensors', and you may use them for your site, free of charge, for as long as you like.

10. Liability

We are liable for damage caused by our failure to perform, up to the amount paid under the quote concerned — or, for a care plan, the fees of the last twelve months. This limit does not apply to intent or gross negligence, nor where the law does not allow it. We are not liable for outages of services we do not operate, such as Cloudflare or your WordPress host.

11. If you are a consumer

You may withdraw from a contract within 14 days of accepting the quote, without giving a reason, by writing to [to be completed] — for example: "I withdraw from the contract for the following service: [service], accepted on [date]. Name, address, date." If you ask us to start work within those 14 days, you pay for what has been done up to your withdrawal; once the service has been fully performed at your express request, the right to withdraw no longer applies (articles 102 to 108 of the Spanish Consumer Protection Act, RDL 1/2007).

12. Changes, law and courts

We may update these terms; an accepted quote stays under the terms in force when it was accepted. These terms are governed by Spanish law. Disputes with business customers go to the courts of the provider's domicile; a consumer may always go to the courts of their own.
